1. Introduction
These Terms govern access to TailwindMail, including the marketing site, editor, templates, workspace, and related features. By creating an account or using the Service, you also agree to our Privacy Policy and Refund Policy.
2. Services Overview
TailwindMail includes:
- A visual editor for building HTML emails with Tailwind CSS.
- A compiler that turns Tailwind source into inline, inbox-safe HTML.
- Preview, test sends, spam checks, export, import, media library, and optional publish links.
- A web-based workspace to manage projects, templates, billing, and account settings.
The Service is provided on a Free plan and a Pro subscription, with plan features and limits as described in the product. Email clients differ. We work to produce compatible markup, but we do not guarantee identical rendering in every inbox.
3. Account Registration
To access most features, you must create an account with email (magic link), GitHub, or Google. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. You agree to provide accurate and complete information and to keep it updated. Notify us promptly if you believe the account has been misused.
4. Subscription & Billing
TailwindMail subscriptions are managed and processed securely via Paddle, our Merchant of Record. Pro is billed automatically on the plan you select (monthly or yearly). Fees are charged in advance. You can cancel at any time from account settings. Your Pro access remains active until the end of the current billing cycle, then the account returns to Free plan limits.
Invoices and receipts are issued by Paddle in accordance with your billing information. We may change plan features or pricing with notice. Continued use after a change takes effect constitutes acceptance.
Refunds are handled in accordance with our Refund Policy and processed by Paddle, our Merchant of Record. Refund eligibility and decisions are determined by Paddle under their terms.
5. Acceptable Use
You agree to use TailwindMail only for lawful purposes and in accordance with these Terms. You may not:
- Reverse-engineer, decompile, or modify the platform except as allowed by law.
- Circumvent plan limits or abuse features such as compiles, exports, test sends, or publish links.
- Share your account in a way that circumvents plan limits.
- Use the Service to send spam, phishing, malware, or other unlawful or deceptive email.
- Upload content you do not have the right to use, or host illegal, harmful, or offensive material.
- Misrepresent compiled output as originating from another person or brand without authorization.
6. Limits & Fair Use
Each plan comes with defined limits (for example projects, templates, and test sends). Free accounts get limited projects and templates; Pro unlocks higher limits as described in the product. Abuse of these limits or attempts to exploit the system may result in suspension or termination of your account.
7. Intellectual Property
All content, code, and features of TailwindMail are owned by otha&Co or our licensors. You may not reuse or redistribute any part of the Service without explicit written permission.
You retain full rights to the markup, copy, and assets you create in TailwindMail. You grant us a limited license to host, compile, preview, and export that content solely to operate the Service.
Starter templates, documentation, and product branding remain ours or our licensors’. You may use templates to create emails for your projects, including commercial use as described in your plan, but you may not resell the templates as a competing template library.
8. Data & Privacy
We collect personal data (such as name, email, workspace content, and usage statistics) solely for the purpose of providing the Service. We do not sell your data. We share it only with service providers needed to run TailwindMail (for example Paddle, GitHub, Google, and email delivery).

9. Availability & Disclaimer
TailwindMail is provided “as is” and “as available.” While we strive to maintain high uptime and performance, we cannot guarantee uninterrupted service.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for:
- Business losses due to downtime.
- Compatibility issues with email clients, mailbox providers, or third-party tools.
- Data loss, compile errors, or export errors.
We do not warrant that compiles, previews, or test sends will be error-free or accepted by every mailbox provider. To the fullest extent permitted by law, TailwindMail and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the amounts you paid us in the 12 months before the claim.
10. Termination
You may cancel your account at any time from account settings. We may suspend or terminate your access if you violate these Terms, abuse the system, harm the integrity of the platform, if required by law, or if we discontinue the product. Upon termination, your right to use the Service ends. If you delete your account, we retain it for 30 days so you can recover it, then delete workspace data unless we must keep records longer.
11. Changes to Terms
We reserve the right to update these Terms at any time. The “Last updated” date at the top of this page will change when we do. Material changes will be communicated via email or in-product notice where reasonable. Continued use of the Service after changes implies acceptance.
